Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("Policy") governs the acceptable use of all data products and services provided by Data Reserve AI L.L.C. ("Provider," "we," "us," or "our"). All customers, users, and recipients of our data products ("Customer," "you," or "your") must comply with this Policy as a condition of accessing and using our services.

2. Lawful Use Requirement

You must comply with all applicable federal, state, and local laws and regulations when using our data products, including but not limited to:

  • The Fair Credit Reporting Act (FCRA)
  • The Telephone Consumer Protection Act (TCPA)
  • The CAN-SPAM Act
  • The California Consumer Privacy Act and California Privacy Rights Act (CCPA/CPRA)
  • All applicable state privacy and data protection laws

You are solely responsible for determining whether your intended use of our data products complies with all applicable laws and regulations. Data Reserve AI does not provide legal advice and makes no representations regarding the legality of any particular use case.

3. Prohibited Uses

You expressly agree that you will not use any data products or services provided by Data Reserve AI for the following purposes:

3.1 FCRA-Prohibited Uses

Our data products are not consumer reports as defined under the Fair Credit Reporting Act (FCRA), and Data Reserve AI is not a consumer reporting agency. You may not use our data for:

  • Credit eligibility determinations, including credit granting, reviews, or collections.
  • Insurance underwriting or eligibility determinations.
  • Employment screening, hiring decisions, or background checks.
  • Tenant or housing screening or rental eligibility determinations.
  • Any other purpose regulated under the FCRA or similar state laws.

3.2 Harassment and Harmful Activities

You may not use our data for:

  • Stalking, harassment, or intimidation of any individual.
  • Doxxing or publishing personal information with the intent to harm or endanger.
  • Discrimination against individuals based on protected classes, including race, color, religion, sex, national origin, age, disability, or genetic information.
  • Physical harm, threats of violence, or facilitating violence.
  • Any activity that targets or exploits vulnerable populations.

3.3 Communication Violations

You may not use our data for:

  • Sending unsolicited commercial emails (spam) in violation of the CAN-SPAM Act.
  • Automated robocalls or telemarketing in violation of the Telephone Consumer Protection Act (TCPA).
  • Caller ID spoofing or misrepresentation of caller identity.
  • Any communication that violates the CAN-SPAM Act, TCPA, or similar federal or state laws.

3.4 Data Misuse

You may not:

  • Resell, redistribute, sublicense, or otherwise make our data products available to third parties without our prior written consent.
  • Attempt to re-identify individuals from anonymized or aggregated data products.
  • Scrape, crawl, or use automated means to supplement our data products beyond authorized usage.
  • Circumvent, disable, or otherwise interfere with technical access controls or security measures.
  • Exceed licensed usage volumes, API rate limits, or other contractual restrictions.

4. Compliance Certification

By accessing or using our data products, you certify and represent that:

  • You have read and understand this Acceptable Use Policy in its entirety.
  • You will use our data products only for lawful purposes consistent with this Policy.
  • You have implemented internal policies and procedures to ensure compliance with this Policy and all applicable laws.
  • You will train all personnel who access or use our data products on the requirements of this Policy and applicable legal obligations.
  • You will cooperate with any compliance audits or investigations requested by Data Reserve AI.

5. Monitoring and Enforcement

Data Reserve AI reserves the right to monitor usage of our data products to ensure compliance with this Policy. We may employ technical measures, audits, and reviews to detect potential violations.

Violations of this Policy may result in one or more of the following actions, at our sole discretion:

  • Immediate suspension of access to our data products and services.
  • Termination of your agreement and all associated licenses.
  • Legal action, including claims for damages, injunctive relief, and recovery of costs and attorneys' fees.
  • Reporting to appropriate regulatory authorities or law enforcement.

Data Reserve AI may require you to certify your compliance with this Policy at any time. Failure to provide timely certification may result in suspension of access.

6. Reporting Violations

If you become aware of any suspected violation of this Acceptable Use Policy, please report it immediately to compliance@datareserve.ai. We take all reports seriously and will investigate promptly.
